Policy
As a user
of the Pacific American Securities website, you have entrusted
us with your personal and financial data. We know that you
are concerned with how this information is treated. This Privacy
Statement sets forth policies that demonstrate our commitment
to your financial privacy. Pacific American Securities is
committed to protecting the privacy of all users of our website
- those who visit our website and those who maintain accounts
with us.
We only
use information about you to help us service you and any account
you might maintain at Pacific American Securities. In addition,
as a financial institution and FINRA member, we also are required
to collect and retain certain information as a legal and regulatory
matter. We limit our collection, use and retention of information
about you in a manner consistent with achieving these goals
and meeting these requirements. We currently do not use any
"cookie" technology on the public area of this website. If
we add any cookies in the future, we will change this notice
to explain how such cookies are used.
We will
only share personal information with others as stated in this
policy, unless we give you additional notice or ask for your
permission. We do reserve the right to disclose or report
personal information in limited circumstances where we believe
in good faith that disclosure is required under law, to cooperate
with regulators or law enforcement authorities, to perform
necessary credit checks or collect or report debts owed to
us, to protect our rights or property, or upon reasonable
request by a mutual fund in which you have chosen to invest.
We seek to limit our employees' access to information about
you to those employees who need to have such information to
service you and your account. We emphasize to our employees
the confidential nature of customer information and the high
level of importance we place on maintaining this confidentiality
through employee training, operating procedures and our privacy
policy. We also maintain physical, electronic and procedural
safeguards that comply with federal standards to guard your
nonpublic person information. For example, we use locked file
cabinets and password-protected computer access. We may collect
nonpublic personal information about you from the following
sources: Your account opening documentation, applications,
or other forms (e.g. name, address, phone numbers, social
security number and date of birth); Your transactions with
us, our affiliates and others; and Information for special
services such as bill payment.
When you
view the public areas of our website, we do not collect or
store any information specifically identifiable to you unless
you knowingly provide it to us. If you are an account holder,
information about you is collected and stored on a secure
portion of our website. Access to portions of the website
where information about you and your account is collected,
retrieved or transmitted is password protected. Your Pacific
American Securities password is your private entry key into
your account. You should never share it with anyone and you
should change it periodically.
In addition
to password protection, any time you enter an order or provide
personal information (such as an account number or password),
we encrypt it using Secure Socket Layer (SSL) technology.
SSL protects information as it crosses the Internet. To support
this technology, you need an SSL-capable browser. Pacific
American Securities recommends using a strong encryption,
128-bit browser like Netscape Navigator 4.06 or higher or
Microsoft's Internet Explorer 4.01 or higher. These browsers
will activate SSL automatically whenever you sign on to your
Pacific American Securities account. You can tell if you are
visiting a secure area within a Web site by looking at the
symbol on the bottom of your browser screen. If you are using
Netscape Navigator or Internet Explorer, you will see either
a lock or a key. When the symbol appears unbroken or the padlock
is in the locked position, your session connection is taking
place via a secure server.
If you
need a strong encryption browser, you can go to the Netscape
Web site or the Microsoft Web site to download the latest
Navigator or Internet Explorer browser. We do not recommend
the use of beta browser versions.
We reserve
the right to use your e-mail address to send you important
information relating to your account, including regulatory
communications. For example, such communications may relate
to margin or trading requirements. At times we may ask for
your informed consent to send important information to you
by e-mail. We may also use your e-mail address to send you
information about services and products we believe may be
of interest to you. If you are a customer and do not want
to receive e-mail related to services and products, simply
log into NetExchange Client and send us an e-mail from the Contact
Us section or call us at 800-864-1014. If you are a customer
or a prospective customer and receive an e-mail from Pacific
American Securities about a product or service, you may unsubscribe
to future e-mails about that product or service by following
the instructions in the e-mail message. Regular non-encrypted
Internet e-mail is not secure. In the instances where Pacific
American Securities Internet e-mail addresses are provided,
these are provided for information inquiries of a non-sensitive
and non-confidential nature. For secure online transmissions
of information to us, you should use Pacific American Securities
Contact Us at www.pacamsecurities.com. Inquiries sent through
our Contact Us pages are secure and use Secure Socket Layer
(SSL) encryption. Since an Internet e-mail response back to
you would not be secure, we will not include confidential
account information in an e-mail response. You may also contact
us by phone at 800-864-1014, U.S. mail at 9191 Towne Centre
Drive, Suite 406, San Diego, CA 92122 or by toll free fax
at 877-552-9833.
We will
not sell or distribute your personal information to any third
party. We may disclose information about you if we deem it
necessary or prudent to do so in the course of a legal proceeding
or in connection with a regulatory matter. Your information
also may be available to other parties, such as our securities
clearing firm, Pershing LLC, which need that information
to allow you to place trade orders and otherwise transact
business with us. We may share aggregate data about our customers
with third parties in an effort to help us develop new and
improved services and products. When we share personal information
with an agent or affiliate, we protect that personal information
with a strict confidentiality agreement. Companies that we
hire to provide support services or act as our agent must
conform to our privacy standards.

instances, the Pacific American Securities website may contain

The accuracy
of your personal information is important to us. If you are
a customer and have a concern about your personal or account
information maintained at Pacific American Securities, or
want to correct, update, or confirm your information, please
send us an e-mail using the Contact Us section of NetExchange Client
or via customerservice@pacamsecurities.com
or call us at 800-864-1014. We will be happy to review and
update our records.
